Animal Protection and Responsible Ownership Law No. 248-12

In 1946, the Dominican Republic enacted Law No. 1268, which imposed penalties for mistreatment of animals. However, over time, both its content and enforcement became inadequate for the needs of modern Dominican society.

Given the increasing frequency of animal abuse and cruelty in the country—incidents that reinforce and perpetuate patterns of violence harmful to animals—several private institutions have emerged in recent years to advocate for animal protection. These organizations remain committed to ensuring the humane treatment of animals on a broad scale.

In this context, the Animal Protection and Responsible Ownership Law No. 248-12 was enacted, repealing the old Law No. 1268 of October 19, 1946. Among other provisions, this law defines an animal as:

“An irrational living being, a sentient creature that feeds on solids and moves, classified by domesticated or bred species into: canines, felines, cattle or bovines, sheep, pigs, goats, horses, as well as birds, fish, rabbits, aquatic animals, or any other wild or captive animal under human control.”

The objectives of this law are:

– To establish the obligations of the State, including sterilization campaigns, vaccination programs, and the creation of animal shelters.
– To prevent and eliminate all forms of mistreatment and cruelty against animals in the Dominican Republic.
– To ensure the health and well-being of animals.
– To foster and promote social awareness regarding the protection and care of animals.

Additionally, the law provides for sanctions and penalties, ranging from fines to imprisonment, depending on the severity of the negligence or abuse committed against the animal. For example, penalties can range from 1 month to 1 year in prison, and fines from 5 to 50 times the minimum wage.

Any citizen may report and follow up on cases of animal abuse through the Animal Protection Unit (UPA) of the Office of the Public Prosecutor, represented by the district attorney’s offices in each jurisdiction.
